Pyidaungsu Hluttaw hereby enacts this Law.
1. This Law shall be called the Seventh Amendment to Region or State Hluttaw Election Law.
2. After Section 11 (l) of the Region or State Hluttaw Election Law, subsection (m) and (n) shall be added as follows;
“(m) A person who has been disqualified by a decision of the Election Tribunal for failing to submit an election expense statement as prescribed.
(n) A Region or State Hluttaw representative representing a political party in a constituency designated under, Subsection (b) of Section 4 who resigns from the party or is expelled from the party in accordance with its rules and constitution.”
3. After Section 11(a) of Section 11 shall be added as follows:
“11-a. A person elected as a Hluttaw representative shall;
(a) If the registration of the political party represented by that person is cancelled under Sub-section
(b) due to any of the matters specified in clauses (4), (5), (6), (7) and (11)of Subsection (a) of Section 12 of the Political Parties Registration Law, the person’s election as a Hluttaw representative shall be deemed automatically void. (b) If the political party represented by that person is dissolved, or its registration as a political party is cancelled under Sub-section (b) due to any of the matters specified in clauses (1), (2), (3), (8), (9) and (10) of Subsection (a) of Section 12 of the Political Parties Registration Law, or if its registration is cancelled under Subsection (e) of Section 24-
(1) If the representative was elected from a constituency under the First-Past-the-Post (FPTP) system, the representative shall apply to the Commission within 60 days from the date of the party’s dissolution or cancellation of its registration, providing valid evidence of membership in another political party, to continue serving as a Hluttaw representative of that party. If no application is submitted within this period, the person’s election as a Hluttaw representative shall be deemed automatically void.
Exception: If the representative wishes to continue serving as an independent Hluttaw representative, the representative may notify the Commission of this intention within 60 days.
(2) If the representative was elected from a constituency under the Proportional Representation (PR) system, the person’s election as a Hluttaw representative shall be deemed automatically void.”
4. Section 28 shall be substituted as follows;
“28. (a) For constituencies specified in Subsections (a) and (c) of Section 4, the respective Hluttaw candidate, and for constituencies specified in Subsection (b) of Section 4, the political party, shall have the right to withdraw a nomination paper for a Hluttaw candidate in accordance with the prescribed procedures.
(b) After the list of Hluttaw candidates has been officially announced, a candidate shall have the right to withdraw from candidacy in accordance with the prescribed procedures.”
5. In the introductory paragraph of Section 30-a of the Region or State Hluttaw Election Law, the expression “political parties” shall be replaced with “central executive committees of political parties”.
6. In Section 42 of the Region or State Hluttaw Election Law, the expression “6 am” shall be replaced with “7 am” and the expression “4 pm” shall be replaced with “5 pm”.
7. In, Subsection (b)of Section 48 of the Region or State Hluttaw Election Law, the expression “two days in advance” shall be replaced with “three days in advance”, and the expression “before 4 pm” shall be replaced with “before 9 am”.
8. In, Subsection (d) of Section 88 of the Region or State Hluttaw Election Law, the expression “a Hluttaw representative or an election representative” shall be replaced with “a Hluttaw representative, a Hluttaw candidate or an election representative”.
9. After Section 88-a of the Region or State Hluttaw Election Law, the following Section 88-b shall be added; “88-b. The Commission shall:
(a) cancel the votes obtained by a political party under Clause 2 of Section 49(b), if the party voluntarily dissolves itself or its registration is cancelled under the Political Parties Registration Law.
(b) for constituencies designated under Section 4 (b), recalculate the remaining valid votes in accordance with the prescribed procedures after deducting the votes cancelled under Subsection (a), and announce the list of elected Hluttaw representatives.
